Contract Terms and Conditions
The following terms and conditions apply to the purchase of course(s) from Focus Training and Learning. If you have any questions relating to these terms and conditions, please get in touch. These terms and conditions do not affect your statutory rights.
“Cancellation Form” means the model cancellation form of the Consumer
Contracts (Information, Cancellation and Additional Charges) Regulations 2013
“Personal data” shall have the meaning set out in the Data Protection Act 1998
“Course(s)” means the training course(s) and other training and learning service(s) offered by Focus Training and Learning
“We/us” means Focus Training and Learning
“You” means the purchaser of course(s) from Focus Training and Learning
“Website” means www.focustrainingandlearning.co.uk or any subsequent URL that may replace it
Terms and Conditions:
Changes to Course(s): We reserve the right to cancel or reschedule any of our course(s). Where it is necessary to cancel or reschedule course(s), you will be informed at the first available opportunity and you will be rescheduled as a priority to the next available course(s). We do not accept any responsibility for certificates expiring as a result of a cancelled course(s). For example regulated First Aid certificates.
Payment: Company group booking/s payment is required prior to the course(s) commencement date and must be a minimum of 10 working days. We reserve the right to withhold candidate(s) certificates until full payment has been received by us. Individual candidate(s) are required to make payment at the time of booking.
Cancellations: For company group bookings, the full course(s) fee will be charged for cancellations made fewer than 10 working days before the course(s) start date. If you are booking as an individual, you have 14 calendar days in which to cancel your booking from the date it was made, unless this is within 14 days of the course/s commencement. If these timescales are met then relevant fees already paid by you will be refunded. Any reimbursement will be by the same method of payment as the original payment unless otherwise agreed by both parties. Group Bookings: This is most likely to be an organisation that books a course/s for their employees. Group bookings will take place within the organisation’s premises or other appropriate premises provided by the organisation. Group bookings must be for a minimum of 5 candidates and the course/s fee will be charged at this cost. Group numbers below 5 will still incur the full cost as if there were 5 candidates attending. Should the organisation not provide the training venue then they will be treated as a scheduled course (see below).
Scheduled Courses: Focus Training and Learning will collate details of interested individuals and organise a scheduled course when there is enough candidate interest to warrant this. Scheduled courses consist of 12 candidates. You can ask to transfer to another course(s) without incurring any charge provided we receive this request at least 10 working days before the course(s) start date. If you book course(s) less than10 working days before the course(s) start date, you cannot transfer to another course, except in the event of illness and you provide us with a medical certificate. You can be substituted with another candidate(s), identified by you; on course(s) provided we receive the request a minimum of one week before the course(s) start date.
Attendance: You must productively engage with and attend your chosen course(s) as per our directions and the assessment specifications for said course(s).
Course(s) Achievement: You must complete all required areas of the course(s) and meet the assessment requirements to qualify for certification. If you do not engage as per course(s) requirements and/or do not pass the assessment the full cost of the course(s) will still be charged. You must complete the course(s) requirements within the specified timeframes. If this is not achieved it may be possible to support you to complete. For example, offering additional time. This is likely to incur further costs. These will be discussed, agreed and paid to us prior to you continuing with your course(s). Failure to adhere to the agreed terms of any additional support will result in you being deregistered from your course(s).
Re-qualification of First Aid at Work Courses: It is you and/or your employer’s responsibility to ensure you hold proof of a current (in date) First Aid at Work certificate that is valid for the duration of the requalification course(s) being attended. You should bring evidence of this to your re-qualification course(s).
Equal Opportunities and Malpractice Policies: To enable us to ensure that you are treated fairly and your requirements are fully met, you must advise us in advance of any special requirements that you need to participate fully in the training. Please note you need English language skills as per the requirements of your chosen course(s). Whilst we are often able to provide support to individuals who, for example do not have English as a first language, our ability to do so is limited. We may be able to make some special arrangements if requested in advance of your course start date. Please note that we do not provide specialist equipment and/or additional personnel such as interpreters.
Candidate Selection: It is the responsibility of the employer to select suitable candidate(s) who are able to meet the requirements of the chosen course(s). Some of our course(s) require a level of physical ability to achieve them. This is especially so in our First Aid At Work and Paediatric First Aid Course(s). Candidates must have the physical ability to be on the floor for some time and have the respiratory capacity to administer cardio pulmonary resuscitation (CPR). In line with the Health and Safety Executive’s (HSE) you must be free from any condition that will affect your participation in the course(s) and your capacity to carry out the duties of a First Aider in the workplace.
Website: We attempt to ensure information available on the website at any given time is accurate. We will not be liable for any errors or omissions. We will use all reasonable means to correct errors and omissions as quickly as possible once they come to our attention. We may make changes to the website from time to time in accordance with our needs and requirements. We will not be held liable or accountable for any viruses that may infect our system and cause damage or corruption to your equipment. We will endeavour to keep our security systems updated and current to minimise any issues in this regard. All materials on the website, including logos, remain our property and should not be replicated or used without our consent or approval.
Limitation of liability: Except in respect of death or personal injury caused by our negligence, we shall not be liable by reason of any representation (unless fraudulent) or implied warranty condition or other term, or any duty at common law or under the express terms of this agreement, for any loss of profit or any indirect special or consequential loss, costs, expenses or other claims for compensation. Our entire liability to you under or in connection with this agreement and the provision of course(s) shall not exceed the sum of twice the contract value. Nothing in this paragraph is intended to exclude any liability on our part for fraud.
Data Protection Act 1998: Non-sensitive personal data collected from you will be used for the purpose of course(s) administration and may be disclosed to appropriate bodies and organisations associated with such course(s). The information may also be used for marketing purposes and you may be contacted with details of future and similar events/course(s) organised or promoted by us that may be of interest to you. We will not send marketing communication to any individual or organisations that have requested their details are not used for such purposes. We take appropriate physical, electronic and managerial measures to ensure that we keep your information secure, accurate and up to date and that we only keep it as is reasonable and necessary in line with current legislation. Contact details supplied to us will not be passed to third parties.
